Service Agreement

Please Read Carefully:

 

DO NOT PAY OR DONATE FOR A PROGRAM OR SERVICE UNLESS YOU FREELY GIVE YOUR INFORMED CONSENT TO TERMS & CONDITIONS OF THIS SERVICE AGREEMENT.

When you engage the professional services of Rev. Katherine "Kim" Lopa DBA One Brotherhood Chapter (hereafter referred to as Facilitator), you enter into a Service Agreement with Facilitator regarding the following Terms of Service:

  1. 48-HOUR CANCELLATION /NO REFUND POLICY.  A 48-hour advance notice is required when canceling an existing appointment, to allow the vacated time slot to be refilled. We value your time, so please value ours. Cancellations past the 48-hour cutoff will not be eligible for a refund. In addition, failure to honor the 48-hour deadline will result in a $75.00 penalty charge on the first occasion, a $150.00 penalty charge on the second occasion, and if a third episode occurs you will be terminated as our client.
     

    • Certain extenuating or "common-sense" circumstances exist in which the 48-hour deadline can be waived and the penalty charge forgiven. These special cases are reviewed for final determination. If there are extenuating circumstances (e.g., natural disasters, severe weather, personal or family emergencies, registration problems, etc.), it is important that you Contact Us immediately. We will be happy to resolve the matter with you. 

    • Facilitator reserves the right to cancel an appointment at any time due to inclement weather, emergencies or other unforeseen circumstances which would make the appointment non-viable. In such case, you would be notified immediately.

    • Facilitator reserves the right to cancel an appointment with due cause, especially if Client violates any of the terms, policies and conditions in this Service Agreement. Client will be duly informed of the cancellation by email.
       

  2. Our REFUND POLICY is as follows:
     

    • ALL PAYMENTS ARE NON-REFUNDABLE except when an application is denied or no more seats are available, in which case payment will be refunded in full. 

    • No refunds will be offered on canceled subscriptions. Paid subscriptions are non-refundable, and no prorated refunds or credits will be offered for partially used subscriptions. We reserve the right to issue refunds or credits at our sole discretion, or as required by applicable law.

    • If we issue a refund or credit in one instance, we are under no obligation to issue the same refund or credit in the future.

    • ALL PAYMENTS ARE NON-TRANSFERABLE. “Non-transferable” means unused payment cannot be transferred to another service, appointment or product in the future, nor to another person, unless stated otherwise.

    • Refunds will not be available for clients who miss an appointment without prompt notice (i.e., No Call No Show). In the case of “No Call No Show,” you agree to indemnify Facilitator by paying the full price of the appointment, event or workshop.

    • If Facilitator cancels an appointment due to inclement weather, emergencies or other unforeseen circumstances which would make the appointment unviable, you will be offered a full refund.​

    • Should unusual circumstances arise that result in the postponement of an appointment, Facilitator will offer to either issue a full refund or transfer your reservation to a future date and time.

    • Facilitator cannot be held liable for any third-party costs, such as travel bookings or accommodation.

    • Prior to rendering service, Facilitator may screen clients for safety reasons, to weed out clients or applicants who are unprepared, unmindful, uncommitted or merely curious. Payment is refunded in full when a client or applicant is denied service or admission after screening. 
       

  3. SAFE SUBSCRIBE. When you fill up any of Facilitator's forms, you subscribe with Facilitator as a Client so that she can process your application through automation, and communicate to you through email, text message, phone, and other electronic means, subject to our Privacy Policy. You can unsubscribe anytime by clicking on the Unsubscribe link at the bottom footer of every email we send you. This will promptly remove you from all future correspondence.
     

  4. HOW WE USE YOUR INFORMATION.  We collect your information in order to understand your needs so that we can provide you with knowledgeable assistance through our services and offers. We may use your information to send you offers, services, events, discounts, etc. However, we do not sell or trade your personal information to outside parties for marketing purposes. We also will not use your Personally Identifiable Information for our marketing activities without your prior consent. This is explained more fully in our Terms of Use and Privacy Policy which are included in the scope of this Service Agreement.
     

  5. CONFIDENTIALITY.  Facilitator is committed to respect the confidentiality of every consultation. You may choose to share your information with others outside the consultation. However, please be aware that others may receive or interpret your story differently and take your words out of context because (1) they have a different history than you, and (2) they are getting secondhand information from you. They can misunderstand the information you tell them, which may influence you to slip into doubt or denial, and snap you out of the pure state you were in at the session.
     

  6. TRUTHFULNESS.  A friend or relative will often tell you what you want to hear, but a results-oriented facilitator will tell you what you NEED to hear. A good facilitator, consultant, mentor or coach will surprise you with his/her straightforwardness and honesty—trusting that if you asked the question, you'll want to hear the hard truth. Make sure this is the kind of no-nonsense honesty you want, because that is exactly what you will get from Facilitator.
     

  7. RESPONSIBILITIES. You are a free will agent solely responsible and accountable for your choices, decisions, actions, omissions and results in life. You agree not to hold Facilitator liable for your choices, decisions, actions, omissions or results, at any time, under any circumstance.  Facilitator can only help you make informed choices but cannot be held responsible for the consequences of your choices or the situations your choices put you in, however informed or uninformed your choices may be.
     

  8. DISCLAIMERS.  Facilitator offers her services to help you focus on creating something that will work for you forever. However, Facilitator does not guarantee results or make warranties of any kind. Facilitator is not responsible for your success or failure because results depend on many factors beyond Facilitator's control, such as your free will choices. Henceforth, you acknowledge and agree that:
     

    • RESULTS VARY FOR EACH INDIVIDUAL. Results depend on your commitment, cooperation, spiritual awareness, inner work, right motivation, actions taken, integrity, follow through, and many other factors. Best results come from co-creating with Source/Creator/First Principle. Since we cannot guarantee who or what you will co-create with, consciously and unconsciously, we state unequivocally that we cannot and WE DO NOT SERVE AS YOUR GUARANTOR OF RESULTS.

    • Furthermore, you agree not to hold us liable for damages arising from your decisions, expectations, actions, omissions, and everything else that you are responsible for. You agree not to hold us liable for the consequences therefrom, at any time, under any circumstance.

    • What We Practice does not replace the care provided by medical or healthcare professionals. Facilitator's services are not substitutes for medical, legal, financial, investment or healthcare advice. For all such needs, please consult the qualified professionals in those fields for their expertise and counsel before acting on any advice or information related to a lifestyle change, health, business or finances. 

    • The testimonials we use are success stories of our clients. Their success stories do not guarantee that you will achieve the same or similar results.

    • Please be aware of our FULL DISCLAIMERS here, which  are included in the scope of this Service Agreement.
       

  9. INFORMED CONSENT.  "Informed consent" means you have read this entire Service Agreement, including our Terms of Use, Privacy Policy, and FULL DISCLAIMERS, and you give this Service Agreement your full approval and compliance. Henceforth, you cannot plead ignorance, excuse or lack of awareness of the terms, policies and conditions set forth in this Service Agreement.
     

    • If you have any issue with this Service Agreement, or questions, please contact Facilitator to address and resolve the matter with you as early as possible.

    • If you do not agree with any of the terms, policies and conditions in this Service Agreement, please cancel your appointment or notify us immediately to cancel it.

Now that you are informed of the rights, responsibilities and legalities of serving you, we would also like you to know that Rev. Katherine "Kim" Lopa is most grateful for the opportunity to best serve you.
